1. Provider Communications

Users can contact providers directly through the communication channels they list (such as WhatsApp, phone, or Instagram).

Beauty Club is not involved in these communications and is not responsible for any agreements, disputes, or transactions that result.

2. Limitation of Responsibility

Beauty Club is not liable for the accuracy, quality, or safety of services, any damage, loss, or injury arising from services, or any miscommunication or dispute between users and providers.

3. User Responsibility

Users are responsible for ensuring that their dealings with providers comply with applicable laws and for verifying the credibility and qualifications of providers before booking.

4. Ownership of Platform Data and Content

All content made available through Beauty Club — including but not limited to the salon directory, provider profiles, service listings, offers, pricing, images, reviews, ratings, category taxonomies, search results, the underlying database, its structure, selection, arrangement, and compilation, as well as all software, source code, designs, trademarks, logos, and the look and feel of the platform — is the exclusive property of Beauty Club and/or its licensors and is protected by applicable copyright, trademark, database, trade secret, and unfair-competition laws of the State of Kuwait and international treaties.

Beauty Club expressly reserves all rights not granted to users under these Terms. No right, title, or interest in any platform content or data is transferred to any user by virtue of accessing or using the platform.

Users are granted a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and view the platform solely for personal, non-commercial use, strictly in accordance with these Terms. Any other use is prohibited without Beauty Club's prior written consent.

5. Prohibited Automated Access, Scraping, and Data Extraction

Users and any third party (including any agent, contractor, automated process, bot, or artificial-intelligence system acting on their behalf) are strictly prohibited from engaging in any of the following activities, whether directly or indirectly, in whole or in part:

(a) accessing, monitoring, indexing, copying, downloading, harvesting, mirroring, caching, scraping, crawling, spidering, or otherwise extracting any data, content, or material from the platform by any automated or systematic means, including but not limited to bots, scripts, robots, headless browsers, screen-scrapers, data miners, or any other software, device, algorithm, or methodology designed to extract or aggregate data;

(b) bypassing, circumventing, disabling, or otherwise interfering with any rate limits, access controls, authentication mechanisms, CAPTCHAs, robots.txt directives, IP blocks, technical protection measures, or any other security or access-restriction features of the platform;

(c) using the platform's content or data, in whole or in part, to build, train, fine-tune, evaluate, benchmark, or enrich any dataset, machine-learning model, large language model, generative-AI system, recommendation engine, search index, or any other artificial-intelligence or analytics product, whether for commercial or non-commercial purposes;

(d) republishing, redistributing, reselling, sublicensing, syndicating, transmitting, displaying, or otherwise making available any platform content or data to any third party, on any other website, application, marketplace, directory, or service, including any platform that competes with or duplicates Beauty Club's offering;

(e) extracting, reverse-engineering, decompiling, disassembling, or attempting to derive the source code, algorithms, schema, or underlying database of the platform;

(f) impersonating any user, provider, or Beauty Club staff member, or misrepresenting your affiliation with any person or entity in order to gain access to platform data;

(g) creating, maintaining, or operating any service, application, plug-in, browser extension, or product that depends on, mirrors, or is materially derived from data obtained from the platform;

(h) using any contact information (including provider phone numbers, WhatsApp numbers, or Instagram handles) listed on the platform for any purpose other than a bona fide personal booking inquiry — including, without limitation, any bulk outreach, marketing, telemarketing, SMS or WhatsApp blasting, lead-generation, list-building, or unsolicited commercial communication;

(i) aggregating or combining any portion of the platform's data with data from any other source for the purpose of creating a directory, database, or comparison product.

The above prohibitions apply regardless of whether the data in question is publicly visible on the platform. The fact that content is accessible without a login does not constitute permission to copy, extract, or reuse it.

6. Enforcement, Remedies, and Damages

Any violation of Sections 4 or 5, or any other unauthorized access to or use of the platform's data or systems, constitutes a material breach of these Terms and may also constitute a violation of applicable laws, including Kuwait Law No. 20 of 2014 on Electronic Transactions, Law No. 63 of 2015 on Combating Information Technology Crimes, Law No. 22 of 2014 on Author Rights and Related Rights, and applicable data-protection regulations.

Beauty Club reserves the right, at its sole discretion and without prior notice, to: (i) immediately suspend or terminate any user account, API key, or access credential; (ii) block any IP address, device, or network associated with the violation; (iii) issue takedown demands to hosting providers, app stores, registrars, and search engines; (iv) refer the matter to the competent authorities in the State of Kuwait or any other jurisdiction; and (v) pursue any and all civil and criminal remedies available under law.

The user acknowledges that any breach of Sections 4 or 5 will cause Beauty Club irreparable harm for which monetary damages alone would be inadequate, and Beauty Club shall therefore be entitled to seek injunctive relief and specific performance, in addition to damages, without the need to post bond.

Without limiting the foregoing, any person or entity that scrapes, extracts, or otherwise misappropriates platform data in violation of these Terms agrees to pay Beauty Club, as liquidated damages and not as a penalty, the sum of KWD 5 per record accessed, copied, or extracted, or KWD 25,000 per incident, whichever is greater, plus all attorneys' fees, investigation costs, and enforcement expenses incurred by Beauty Club. The parties agree this amount is a reasonable pre-estimate of the harm caused, given the difficulty of quantifying the loss of competitive advantage, provider trust, and database value.

Beauty Club's failure to enforce any provision of these Terms in any instance shall not be deemed a waiver of its right to enforce that provision, or any other provision, in the future.

7. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Kuwait, without regard to its conflict-of-laws principles. The courts of Kuwait City shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the use of the platform.
